Although not a case relating to the environment this case does involve an interesting point of procedure relating to use of expert witnesses. In this case, the Judge held that expert evidence must be evaluated having regard to all the circumstances relating to the expert and the weight given to such evidence may be affected by the fact that he is giving evidence under an arrangement involving a contingent fee. The Judge in question stated that in future he would adopt a practice of asking the expert witness whether or not he is acting on a contingency basis if the Counsel calling the witness had not already asked the question.
