Norbrook Laboratories appealed against a decision of Carlisle Magistrates' Court which included aspects of the Magistrates' own personal local knowledge. The Court accepted that Magistrates were permitted to factor local knowledge into their decisions, but held that the parties must be notified of this if it is the Magistrates' intention to do so. Notification gives the parties the opportunity to comment. As the Magistrates failed to notify Norbrook Laboratories (GB) Limited of their intentions, its appeal in this case was upheld. Local knowledge is likely to be of significance in many cases concerning the environment. (Times Law Reports, 23 February 1998)
