Digital Satellite Television Platform TPS – France

The Commission has authorised the agreements creating the Digital Platform Television Par Satellite (TPS). TPS is being launched on the French paid television market as a competitor of Canal Plus and Canal Satellite, and of AB-SAT. The agreements are concluded by four French broadcasters (TF1, M6, France 2 and France 3) as well as by France Telecom and Suez Lyonnaise des Eaux to create TPS. This company operates a digital paid TV platform by satellite, which is also distributed on cable networks in France. In the future, TPS could also be distributed in the European French-speaking areas.

The Commission declared that the creation of TPS does not restrict competition and does not fall under Article 85 of the Treaty that prohibits ant-competitive behaviour. However, two clauses in the agreement limited the access of competitors to certain types of contracts. These clauses have now been amended in their scope to the satisfaction of the Commission.

The Commission believed that in the French market, where three digital satellite television platforms co-exist (Canal Satellite, AB-SAT and TPS) the agreement would promote technological progress and benefit consumers given the increased pay TV offer and more advantages subscription conditions.
