We have recently published a copy of a paper which we sent to the European Commission in response to calls for comments on its Green Paper on legal aid in civil matters COM (2000) 51. The Green Paper proposed that cross-border rules of European member states or legal aid should be harmonised, with the implication that many member states should spend more on legal aid provision. Such a system would undoubtedly encourage not only cross-border litigation but also national litigation. That would have major implications for encouraging product liability, environmental or similar claims.
