Crimes involving fake or shoddy goods further defined 2

China

The Interpretation on Several Issues Concerning the Laws Applicable in the Handling of Criminal Cases of Producing and Selling Fake or Shoddy Goods was adopted by the Judicial Committee of the Supreme People's Court on April 5, 2001 and by the Procuratorial Committee of the Supreme People's Procuratorate on March 30, 2001, effective April 10, 2001.

The interpretation clarifies certain provisions in China's criminal law on crimes involving the production and sale of fake or inferior goods.

In particular, it provides definitions for the provisions in article 140 of the criminal law on "producers and sellers who mix improper or fake elements into products", "pass off fake products as genuine products", "pass off shoddy products as good-quality products" or "pass off substandard products as products that are up to standard". It also provides a definition of "sales revenue". It elaborates on the provisions in the criminal law on crimes involving pharmaceuticals, foods and medical instruments.
