New court system in Russia for administrative disputes

On 21 September 2000, the Supreme Court of the Russian Federation presented the State Duma (the lower house of the Russian Parliament) with a draft of the Constitutional Law "On the Federal Administrative Courts in the Russian Federation". The Duma adopted the draft in the first reading on 22 November 2000 and scheduled the second reading for April 2003.

The draft provides for the creation of a specialised court system to consider administrative disputes, including disputes between the "subjects" of the Russian Federation and their governing bodies, claims against federal and local authorities, election disputes and other disputes arising from the performance by the federal and local authorities of their duties.

The draft also provides for the creation of more than 500 Federal Inter-regional Administrative Courts (courts of primary jurisdiction for administrative disputes), 21 Federal District Courts (courts of secondary jurisdiction) and a Special Administrative Panel under the Supreme Court of the Russian Federation.

The creation of the administrative court system will make it easier to deal with the increasing number of administrative disputes and ensure a much higher level of expertise in considering such cases due to the specialised, professional nature of the new courts and the judges.
