Guide to banking and insolvency law July 2007

Welcome to the July issue of The Heavyweight. A few things to note this month:

  • Under the Companies Act 2006, draft regulations for registration of company charges have been published (The Companies (Prescribed Particulars of Company Charges) Regulations 2007);
  • The Parliamentary recess for summer started on Friday 27th of July so a lot of legislation was pushed through last week. Note in particular the Corporate Manslaughter & Corporate Homicide Act, the Tribunals, Courts and Enforcement Act and the Rating (Empty Properties) Act, which may have an effect on insolvency office-holders.
  • There is a summary of a case where there was argument over whether a document was a deed. The fact that the agreement had been witnessed and the parties had given their full names and addresses and used formal language was not enough to show the parties intended the document to have the extra status of being a deed. (HSBC Trust Company v Quinn).
