Life insurance policies: precautionary attachment is viable in criminal proceedings

The Italian Supreme Court, by judgment no. 18736/2014, deposited on May the 6 th 2014, has clarified the principle that, in case of criminal proceedings, life insurance policies can be subject to real precautionary measures“execution cannot be levied on sums due by the insurer to the contracting party or to the beneficiary, nor can such sums be subject to provisional remedies”, such as precautionary attachment. Indeed, the prohibition provided for Article 1923 of the Italian Civil Code - – does not operate in said circumstances.
