Welcome to the 2024 edition of the CMS Annual Review of developments in English oil and gas law, featuring commentary and analysis on the latest developments in English oil and gas law.

This year’s edition of the Oil and Gas Annual Review covers judgments/arbitral awards which will have both direct and indirect impacts on oil and gas practitioners. Significantly, most cases continue to arise as a result of the energy trilemma, requiring the need to strike a balance between energy security, affordability and sustainability. 

The 2024 Annual Review deals with recent case law relevant to oil, gas and commodity sales, energy taxation, M&A, shipping, production sharing contracts, protestor action, impact of climate change laws on obtaining government consent, and more issues that impact the day-to-day workings of the oil and gas industry.

This year’s edition looks at decisions taken by a range of bodies which are likely to have a significant impact on the industry, including a United Kingdom Supreme Court decision on licencing consent in the context of climate change and a decision of the European Court of Human Rights that interprets Article 8 as encompassing a right for individuals to effective protection by the State authorities from serious adverse effects of climate change on their life, health, well-being and quality of life.
