Training obligations: the clock is ticking!

The clock is ticking: registration for training offered by employers must be completed before the end of November 2024. Although the legislator is discussing an extension of the deadline, caution is recommended and registration obligations must be respected for the time being.

As a reminder, employers have training obligations required by law or by collective bargaining agreement.

In this regard, note the two following deadlines:

  • Employers with 20 or more employees must draft a training plan for their employees by 31 March at the latest (with consultation/communication obligations with employees or employee representatives). In principle, the content of the training plan is only determined once per calendar year and is valid for minimum one year.
     
  • All employers of the private sector (regardless of the number of employees) must register the individual training days granted for each employee for 2024 through the Federal Learning Account by 30 November 2024 at the latest.

    Employers are then expected to (i) update employees’ data if needed; and (ii) indicate trainings performed, every quarter, by the same deadline as the one applicable for the social security declarations.

Regarding the registration obligation, discussions are currently being held in the Belgian parliament for a possible postponement to 1 April 2025 (1 June 2025 has also been mentioned).

However, note that (i) 30 November 2024 remains applicable as long as no other date has been approved; and (ii) this possible postponement does not impact the content of the training obligation (i.e. to provide training days and set up a training plan), but merely applies to registration.
