Romanian Consumer Protection Authority wants traders to inform consumers of price mark-up details

The Romanian Consumer Protection Authority has posted a draft order for public consultation, which, if passed, would require economic operators to inform consumers about the mark-up applied by them to the acquisition cost of the products sold.

According to the authority, this new obligation will enhance consumer protection standards and ensure consumers are able to make rational, well-informed choices.

The Romanian Consumer Protection Authority states there has been a lack of transparency towards consumers on how economic operators set prices starting from the acquisition price, and that the general statutory right of consumers to be adequately and correctly informed prevails over the economic operator’s rights to protect commercial or professional secrets related to setting prices.

In its operative section, the draft order requires economic operators to inform consumers, either on the label of the product or in the immediate vicinity where the product is placed for sale, of the mark-up applied by the operator in relation to the product acquisition price. This information should be provided in the same field of vision as the price, using the same font as the price in terms of colour, size and other characteristics.

Similar obligations also apply to online sales, where sellers must inform the consumers of the mark-up applied in relation to the acquisition price, by providing this information in the same field of vision as the price and in the same font, in terms of colour, size and other characteristics.

The authority issued the draft on 18 March 2025, which will be subject to public consultations until 28 March 2025. If adopted, the draft order will enter into force 30 days after publication in the Official Gazette of Romania.
