    HMT: Improving the effectiveness of the Money Laundering Regulations

    HMT’s consultation principally covers issues with the MLRs already identified by HMT, for example in the 2022 Review of the UK’s anti-money laundering and counter-terrorist financing regulatory and supervisory regime.  The consultation covers four core themes: (i) making customer due diligence more proportionate and effective, (ii) strengthening system coordination, (iii) providing clarity on scope of the MLRs and (iv) reforming registration requirements for the Trust Registration Service.  In parallel with this consultation, HMT is running a survey on the cost of compliance with the MLRs in order to help it understand better how regulated businesses comply with the regulations and to assess the impact of future changes to the MLRs.  Responses are required by 9 June 2024.

    FCA has announced that it will not object to requests from RIEs to create a UK listed market segment for cETNs.  These products would be available for professional investors, such as investment firms and credit institutions authorised or regulated to operate in financial markets only.  If an RIE creates a new UK listed market segment, FCA will consider applications on a case-by-case basis for listing cETNs on the Official List.  Exchanges must have the appropriate safeguards in place to ensure that the market segment is accessible to professional investors only.
