FCA has alerted firms to the sanctions announced on 22 February 2022, emphasising the powers of FCA and OFSI with regard to financial crime.

These Regulations are made under the Sanctions and Anti-Money Laundering Act 2018 to amend the Russia (Sanctions) (EU Exit) Regulations 2019/855 and amend the designation criteria. Under the amended criteria, an “involved person” now includes a person who is or has been involved in “obtaining a benefit from or supporting the Government of Russia”. This new inquiry will explore the “significant challenges” to the global economy, which contribute to corruption and insecurity. It will also consider fintech innovations, such as cryptocurrency and CBDCs. The Committee has published a call for evidence, with responses required by 15 March 2022.

This guidance note sets out HMG’s approach to tackling terrorist financing and provides an overview of the counter-terrorism sanctions regimes. It concludes that HMG continues to build its understanding and awareness of emerging terrorist financing trends by working closely with organisations which include financial institutions, FATF and banking sectors to exchange and analyse this information.

In January 2021, the EC announced that it would consider amending the Blocking Statute, to further deter and counteract the unlawful extra-territorial application of sanctions to EU operators by countries outside the EU, The EC is now inviting comments on a roadmap, to be received by 30 August 2021.

These Regulations bring into force paragraph 8(4) of Schedule 3 to the Sanctions and Anti-Money Laundering Act 2018 which provides for the repeal of ss152 to 156 of the Policing and Crime Act 2017.
