Review of Legal Costs in Scotland: Consultation Paper issued

Following our Alert on Review of Legal Costs in Scotland earlier this year, the Scottish Government has published Sheriff Principal Taylor’s Consultation Paper on Expenses and Funding of Civil Litigation in Scotland. The Consultation Paper can be viewed here.

The Consultation document covers a wide range of issues, including:

the predictability of the cost of litigation;
the availability of protective expenses orders in public interest cases; and
the litigation market in Scotland.

Public meetings will be held across Scotland during the consultation period, which will close on 16 March 2012. Sheriff Principal Taylor’s report is expected before the end of 2012.
