Infringement proceedings against Greece and Spain

The Commission has sent Greece a reasoned opinion (the second stage of infringement proceedings under the EC Treaty) for failure to comply with the judgment of the ECJ in May 1996 in which the ECJ condemned Greece's failure to implement the 1992 Directive on the award of public service contracts. The Directive should have been implemented by 1 July 1993.

If Greece does not respond satisfactorily within two months of receiving the reasoned opinion, the Commission may decide to bring the matter before the ECJ with the request that it impose penalties.

The Commission has also sent a reasoned opinion to Spain for its failure to implement the 1993 Directive on the award of public contracts in the water, energy, transport and telecommunications sectors. The implementation deadline was 1 July 1994, but Spain was granted an extension until 1 January 1997.
