DGFT’s proposed rules on fees

The Director General of Fair Trading has published its draft rules on fees in connection with the exercise of specified functions under Part I of the 1998 Competition Act. The rules are based on the principle of full economic cost recovery. It is proposed that there should be one fee for considering applications for guidance and a separate fee for considering applications for a decision. It is proposed to charge a fee of £5, 000 for examining an agreement under section 13 or considering conduct under section 21 and £13, 000 for examining an agreement under section 14 or considering conduct under section 22. The fee will be payable on the filing of a notification and will not depend on the outcome of the notification. Comments should be sent to the OFT by Friday 24th December 1999. (OFT 425)
