Case Update: MNS Mining Limited

Earlier this year (click here) we reported the death of four men who became trapped in a coalmine in South Wales when it flooded. Charges were brought under the Corporate Manslaughter and Homicide Act 2007 against the company, MNS Mining Limited and against the manager of the coalmine, Malcolm Fyfield, in respect of gross negligence manslaughter.

MNS Mining Limited was charged with four counts of corporate manslaughter. The Crown Prosecution Service stated that MNS Mining Limited had been charged because of the way in which its activities were managed by senior management and its failure to ensure a safe system of work was in place, amounting to a gross breach of the duty of care owed by the company to the four mine workers.

The manager of the coalmine, Malcolm Fyfield, was charged with four counts of gross negligence manslaughter. The Crown Prosecution Service concluded, following their investigations, that there is sufficient evidence to bring these charges.

Yesterday at Swansea Crown Court, MNS Mining Limited pled not guilty to the four charges of corporate manslaughter and Mr Fyfield pled not guilty to the four charges of gross negligence manslaughter.

The trial is to be held on 24 March 2014.
