Turkey: The period of the dismissal ban was again extended by two months

The Presidential Decision numbered 3344 (“Decision”) was published in the Official Gazette on 30 December 2020 and extends the period of dismissal ban for another two (2) months.

Background

As indicated in this previous Law-Now article, a ban on dismissal of employment contracts was introduced and had been in force since 17 April 2020 under the Law on Reduction of the Effects of New Coronavirus on Economic and Social Life and Amendments to Certain Laws. This prohibition applied in all circumstances, except in cases of breaches of the principles of morality and goodwill (e.g. serious breaches of company policies, harassment).

Furthermore, the Law on the Establishment of Digital Platforms Commission and Amendment of Certain Laws entered into force on 28 July 2020, extending the exceptions to the prohibition on dismissal, as explained in detail in this previous Law-Now article.

Since then, the period of the measure has been extended several times. With the Decision, the period of the prohibition on dismissal has been extended again by two (2) months from 17 January 2021. Thus, the dismissal ban is currently valid until 17 March 2021.
